Aspiryon services are warranted against defects in material and workmanship while used in normal service for a period of one (1) year. This Limited Warranty begins from the date of sale to the original consumer customer.
Aspiryon’s obligation is limited to the repair or replacement of any defective part if the unit is returned, transportation prepaid, to Aspiryon. This Warranty shall apply only when the product is used and/or installed in accordance with the instructions and good industry practices. This Warranty is void if damage is caused by or attributed to acts of God, physical or electrical misuse or abuse, neglect, repair, or alteration, improper or abnormal usage, or faulty installation, or if for any other reason Aspiryon determines that such equipment is not operating properly as a result of causes other than defects in material and workmanship. The sole obligation of Aspiryon, and the purchaser’s exclusive remedy, shall be limited to replacement or repair only, at Aspiryon’s option.
In no event shall Aspiryon be liable for any special, collateral, incidental, or consequential damages for (i) breach of any of the provisions hereof, including, without limitation, provisions regarding warranties, guarantees, and/or indemnities; or (ii) any claims by the purchaser concerning the goods or their use, including, without limitation, claims for loss of goodwill, loss of profit or revenues, loss of use, costs of removal, installation or reinstallation, personal or property injury of any kind to the purchaser or anyone else, theft of or damage to the protected area or its contents, and/or any inability on the part of the purchaser to use the equipment. This Warranty is not an insurance policy against loss.
This Warranty is in lieu of all other warranties, whether expressed or implied, or arising by law, custom, or conduct, including, without limitation, the warranties of merchantability and/or fitness for any particular purpose. Aspiryon reserves the right to change specifications without notice and without incurring any obligation to similarly alter services previously purchased.
